What is Bill 88, the Working For Workers Act, 2022 

On April 11, 2022, Bill 88, Working for Workers Act, 2022, received royal assent in Ontario. It makes several changes to the Employment Standards Act and adds new provisions that will impact employers. These include: 

  • Electronic monitoring of employees. 
  • Reservist leave. 
  • On-site naloxone kits. 
  • Enaction of the Digital Platform Workers’ Rights Act, 2022 (DPWRA). 

It also changes the Occupational Health & Safety Act by: 

  • Increasing fines for non-compliance  
  • Extending the limitation period ​for prosecutions ​

How does this impact your Ontario business? 

If you employ 25 or more people you must have a policy for electronic monitoring of employees. This policy will have to include how you collect data and what you do with it. 

Further, the Occupational Health & Safety Act has been amended. Employers must now provide and maintain naloxone kits in their workplaces if they become aware of the risk of any workers having an opioid overdose.

The fines for contravention by a person under OHSA have also increased to $500,000 (from $100,000). Directors who violate OHSA or fail to comply with their duty to take reasonable care, orders, and any requirements of inspectors would be guilty of an offense. On conviction, they would be liable to a maximum fine of $1,500,000 or imprisonment.
